Summary:   This North Dakota bill is to create and enact a new section to chapter 36-01 and chapter 36-21.2 of the North Dakota Century Code, relating to the duties of the state board of animal health and the treatment of animals; to repeal sections 36-21.1-01, 36-21.1-02, 36-21.1-03, 36-21.1-03.1, 36-21.1-04, 36-21.1-06, 36-21.1-12, and 36-21.1-13 of the North Dakota Century Code, relating to the treatment of animals; and to provide a penalty. Specifically, the bill defines neglect, animal abuse, animal cruelty, and animal abandonment, while also setting out penalties for each of these crimes. For instance, a person guilty of  neglect or abandonment will be guilty of a class A misdemeanor, but a person guilty of animal abuse will be guilty of a class A misdemeanor on the first and second offense and a class C felony on the third and subsequent offenses committed within 10 years. For animal cruelty, on the other hand, a person guilty of violating that provision will be guilty of a class C felony on the first offense.
