Marino v. Nat'l Oceanic & Atmospheric Admin. | 33 F.4th 593 (D.C. Cir. 2022) | Plaintiff animal welfare organizations sued the National Marine Fisheries Service (NMFS) and its parent agency, the National Oceanic and Atmospheric Administration, seeking to enforce conditions in permits held by SeaWorld. The permits authorize the capture and display of orcas and require display facilities to transmit medical and necropsy data to the NMFS following the death of an animal displayed under the terms of a permit. In 1994, the Marine Mammal Protection Act (MMPA) was amended such that it shifted authority to oversee conditions of marine mammals at exhibitors from NMFS to the Animal and Plant Health Inspection Service (APHIS). After three pre-1994 orcas died at SeaWorld, plaintiffs tried to convince NMFS that it still had the authority to enforce the pre-1994 rules related to release of records, but NMFS contended that its authority was extinguished in 1994. Plaintiffs brought suit, arguing that the NMFS's policy rests upon an arbitrary and capricious interpretation of the MMPA, and that its refusal to enforce the permit conditions was also arbitrary and capricious. The district court dismissed the plaintiffs’ suit for lack of standing. On appeal here, the court examined plaintiffs' standing under the three-part Lujan test. The court found a lack of redressability for the plaintiffs. Plaintiffs fail to allege any facts from which the court could infer the relief they seek would likely cause the NMFS to redress their alleged harms. In fact, because the MMPA language on permits is permissive, NMFS has discretion whether to enforce them. This is coupled with the fact that there is no evidence that third-party SeaWorld will turn over the reports even if NMFS were to direct them. Therefore, this court held that the district court did not err in determining that the plaintiffs lacked standing to pursue this case. Affirmed. |
Nantucket Residents Against Turbines v. U.S. Bureau of Ocean Energy Mgmt. | 100 F.4th 1 (1st Cir. 2024) | In this case, the U.S. Bureau of Ocean Energy Management (“BOEM”) approved the construction of Vineyard Wind, a wind power project off the coast of Massachusetts after consulting with the National Marine Fisheries Service (“NMFS”). A group of Nantucket residents, organized as "Nantucket Residents Against Turbines" (“Residents”), allege that the federal agencies violated the Endangered Species Act by concluding that the project's construction likely would not jeopardize the critically endangered North Atlantic right whale. The United States District Court for the District of Massachusetts granted summary judgment for BOEM and NMFS. On appeal of summary judgment, the Residents further allege that BOEM violated the National Environmental Policy Act by relying on NMFS's flawed analysis. The court rejected the Residents' argument, finding that NMFS's biological opinion properly analyzed the current status and environmental baseline of the right whale. Further, the biological opinion properly analyzed the effects of the project (e.g., noise) on the right whale, along with mitigation measures, and did not ignore the project's additive effects on the right whale's long-term recovery prospects. Finally, BOEM's reliance on the biological opinion did not violate NEPA. The judgment of the district court was affirmed. |

The defendants temporarily enjoined from deploying Low Frequency Active Sonar until a carefully tailored preliminary injunction can be issued which would permit the use of Low Frequency Active Sonar for testing and training in a variety of ocean conditions, but would provide additional safeguards to reduce the risk to marine mammals and endangered species. |

Pacific Ranger, LLC v. Pritzker | 211 F. Supp. 3d 196 (D.D.C. 2016) | Pacific Ranger, LLC, a deep-sea commercial fishing vessel, filed suit arguing that a decision made by an Administrative Law Judge (ALJ) should be set aside by the court. The National Oceanic and Atmospheric Administration (NOAA) filed an action against Pacific Ranger for violating the Marine Mammal Protection Act (MMPA) after the vessel set its fishing net on whales during five tuna-fishing expeditions. After the hearing, the ALJ determined that Pacific Ranger had violated the MMPA and was liable for $127,000 in civil penalties. Pacific Ranger argued that these penalties should be set aside because the MMPA was unconstitutionally vague about what was considered an “incidental” taking and the ALJ’s findings could not be supported by substantial evidence. Ultimately, the court reviewed the arguments made by Pacific Ranger and found them to be without merit. First, the court determined that the MMPA was not vague with regard to incidental takings. The court held that incidental takings under the MMPA were restricted to takings that occurred without any knowledge and that this provision needed to be read narrowly in order to give effect to Congress’ intent that maintaining the “healthy populations of marine animals comes first.” The court found that because Pacific Ranger had knowledge that whales were in the area at the time that they were fishing, the taking that occurred could not be considered incidental. Lastly, the court reviewed Pacific Ranger’s argument that the ALJ’s decision could not be supported by substantial evidence. The court rejected this argument, pointing to expert testimony that said that there was no possible way for the Pacific Ranger not to have seen that whales were in the area at the time the takings occurred. As a result, the court affirmed the ALJ’s decision. |
People for Ethical Treatment of Animals, Inc. v. Miami Seaquarium | 879 F.3d 1142 (11th Cir. 2018) | PETA, an animal rights organization, brought this action in July 2015 to enjoin the Miami Seaquarium. The injunction would force the marine park to relinquish possession of a killer whale, Lolita, by releasing her to a sea pen. The grounds for this injunction is an alleged violation of section 9(a)(1)(B) of the Endangered Species Act by the marine park when they confined the killer whale in such conditions that the confinement amounted to a taking of the endangered species of animal. PETA specifically alleged that the marine park took Lolita by harming and harassing her, citing thirteen different injuries that were directly caused by her confinement quarters. When Lolita’s species was recognized as an endangered species by the Act, it specifically excluded captive members of the species. Just two months prior to filing suit, PETA had successfully lobbied to have that exclusion removed from the listing, enabling the suit itself. The district court held for summary judgment in favor of the marine park, saying that to have taken an animal would require a grave threat or potential for a grave threat to the animal’s survival, and PETA did not provide evidence of conduct that met that standard. In this appeal, the court affirms the district court’s summary judgment, but disagrees with their standard for a taking of an animal. After lengthy analysis of the statutory language, this court lowers the standard to posing a threat of serious harm to the animal, rather than death of the animal. However, this court also holds that PETA did not prove that the Seaquarium’s confinement of Lolita met this standard either. Affirmed. |

The court reversed appellant's conviction for taking a marine mammal under the MMPA. It held that the MMPA and the regulations implementing the act did not make it a crime to take reasonable steps to deter porpoises from eating fish or bait off a fisherman's line. |
U.S. v. Zarauskas | 814 F.3d 509 (1st Cir. 2016) | Defendant was found guilty by a jury of illegally importing narwhal tusks under several federal laws, including the Lacey Act, the Endangered Species Act, and the Marine Mammal Protection Act, among others. On appeal, defendant contends that the district court erred by allowing and failing to cure statements by the prosecutor that allegedly violated defendant's Fifth Amendment protections. Prior to being charged, defendant met with FWS and Canadian agents where he did not proclaim his innocence when questioned on the tusks. In the process of showing inconsistency in defendant's statements, the prosecutor pointed out defendant's failure to state his innocence with the federal agents, which defendant claimed improperly burdened him at trial. Other arguments by defendant also pointed to error by the prosecution during direct examination and rebuttal argument with respect to defendant's silence during interviews with agents. The appellate court found the errors to be harmless or in response to defendant's attorney's statements. Finally, as a matter of first impression, the court found that Treasury Enforcement Communications System (TECS) reports logging date, time, and location of border crossing and license plate of the vehicle were admissible hearsay. The convictions were affirmed. |

Some parasail operators brought an action against state officials challenging validity of a state law that banned parasailing in navigable waters. Defendants argued that the court's order should be reconsidered in light of an intervening change in federal law that they say allows for the seasonal parasailing ban. After vacation of summary judgment in favor of operators, 2005 WL 1910497, the state moved for relieve from final judgment. The District Court held that the federal law permitting Hawaii to enforce state laws regulating recreational vessels for purpose of conserving and managing humpback whales did not violate separation of powers doctrine, and federal law did not violate Equal Protection Clause. |

This appeal turns on whether the Marine Mammal Protection Act ("MMPA"), and related regulations, apply to an American citizen taking dolphins within the territorial waters of a foreign sovereign state. The defendant-appellant, Jerry Mitchell, is an American citizen convicted of violating the Act by capturing 21 dolphins within the three-mile limit of the Commonwealth of the Bahamas. The court held that the criminal prohibitions of the MMPA do not reach conduct in the territorial waters of a foreign sovereignty and reversed the conviction. |
Whaling in the Antarctic | Whaling in the Antarctic (Austl. v. Japan), 2010 Judgment. | In June 2010, Australia commenced proceedings against Japan at the International Court of Justice (ICJ), alleging that Japan has continued an extensive whaling program in breach of its obligations as a signatory to the International Convention for the Regulation of Whaling (ICRW). At issue was the moratorium on commercial whaling agreed upon in the 1980s. According to Australia, though Japan claimed to be killing whales purely for scientific reasons, the true purpose of the program was commercial. Japan did not deny that it was killing whales in the Antarctic, but claimed instead that because the ICRW grants each nation state the right to issue licenses for scientific whaling as it sees fit, Japan’s whaling program was legal. The ICJ ruled that Japan's Antarctic whaling program was not actually for scientific whaling and must end. |
