Summary: This law modifies Law No. 19.162, increasing sanctions for violations of animal health regulations in slaughterhouses, and information falsification in the livestock and meat traceability system. This law increases monetary fees from 100 monthly tax units (UTM) to 500 UTM. In addition it adds a paragraph to artiicle 8 of Law No. 19.162 stating the following: "The person who, in an export process, incurs violations of this law related to animal health or traceability will be sanctioned with a fine of 100 to 1,000 monthly tax units and with the confiscation of the products. Additionally, they will be sanctioned with the prohibition of export between three to five years. In case of recidivism within the five years following the end of the prohibition, the conduct will be sanctioned with the perpetual prohibition to export. In the case of a legal person, the same sanction will fall on the natural person or persons controlling the said company and the other companies they control."

MODIFICA LA LEY Nº 19.162 PARA AUMENTAR SANCIONES A QUIENES INFRINJAN NORMAS SOBRE SALUD ANIMAL EN LOS MATADEROS O ADULTEREN O FALSIFIQUEN INFORMACIÓN EN EL SISTEMA DE TRAZABILIDAD DEL GANADO Y LA CARNE 

Teniendo presente que el H. Congreso Nacional ha dado su aprobación al siguiente proyecto de ley originado en moción de los diputados Harry Jürgensen Rundshagen, Miguel Mellado Suazo, Diego Paulsen Kehr, Cristóbal Urruticoechea Ríos, Frank Sauerbaum Muñoz, Jaime Naranjo Ortiz; de la diputada Alejandra Sepúlveda Orbenes, y de los diputados Pedro Pablo Álvarez-Salamanca Ramírez, Jorge Sabag Villalobos e Ignacio Urrutia Bonilla,

Proyecto de ley

"Artículo único.- Modifícase el artículo 8° de la ley N° 19.162, que establece sistema obligatorio de clasificación de ganado, tipificación y nomenclatura de sus carnes y regula funcionamiento de mataderos, frigoríficos y establecimientos de la industria de la carne, en la forma que se indica:

1. Reemplázase el guarismo "100" por "500".

2. Agrégase el siguiente inciso final:

"La persona que, en un proceso de exportación, incurriere en infracciones de esta ley relacionadas con salud animal o trazabilidad será sancionada con multa de 100 a 1.000 unidades tributarias mensuales y con el comiso de los productos. Adicionalmente, será sancionada con la prohibición de exportar entre tres a cinco años. En caso de reincidencia dentro de los cinco años siguientes al término de la prohibición, la conducta será sancionada con la prohibición perpetua para exportar. Tratándose de una persona jurídica, la misma sanción recaerá sobre la o las personas naturales controladoras de dicha sociedad y las demás sociedades que sean controladas por éstas. “.”.

Y por cuanto he tenido a bien aprobarlo y sancionarlo; por tanto, promúlguese y llévese a efecto como Ley de la República.
