THE PRESIDENT OF THE REPUBLIC
WHEREAS:
THE CONGRESS OF THE REPUBLIC;
Has given the following law:
LAW THAT AMENDS LAW 30407, LAW OF PROTECTION AND ANIMAL WELFARE, TO INCORPORATE THE ADOPTION AND IDENTIFICATION OF COMPANION ANIMALS.
Article 1. Modification of Article 5 of Law 30407, Law for the Protection and Welfare of Animals.
Paragraph 5.3 is modified by incorporating part (e) of Article 5 of Law 30407, Law for the Protection and Welfare of Animals, in the following terms:
"Article 5. Duties of persons
5.3 The owner, person in charge, or person responsible for a companion animal must obligatorily attend to the following fundamental needs:
e. To procure the due identification and location of the companion animal through the use of technological means of identification and tracking".
Article 2. Incorporation of Article 21-A in Law 30407, Law for the Protection and Welfare of Animals.
Article 21-A is incorporated into Law 30407, Animal Protection and Welfare Law, in the following terms:
"Article 21-A. Adoption of companion animals
21-A.1. Local governments, in coordination with competent public sectors, animal protection and welfare associations, the private sector, and natural persons, may organize campaigns for the adoption of companion animals in a state of abandonment. The declaration of a state of abandonment is regulated in the regulations of the present law.
21-A.2. Animal protection and welfare associations, refuges, shelters, or other natural persons that give up an abandoned pet for adoption must communicate to the corresponding local government or competent authority, on a monthly basis, a list of the animals given up for adoption with information on the identification and location of the adopter, providing, if available, a copy of the commitment document signed by the adopter.
21-A.3. The adopter must be informed regarding the health, physical condition, or situation in which the animal was taken.
21-A.4. Local governments shall follow up and verify compliance with the protection and welfare measures for animals given up for adoption under the legislation in force and their competencies.
21-A.5. Animal protection and welfare associations, shelters, refuges, or other natural persons shall monitor the situation of a pet given up for adoption, in case they find any indication of a practice that could undermine the protection and welfare of the animal and must communicate it to the corresponding local government.”
