Huntingdon Life Sciences, Inc. v. Stop Huntingdon Animal Cruelty


Animal rights protestors appealed the decision of the Supreme Court, Westchester County that permanently enjoined the protestors from engaging in protest activity that constituted a private nuisance (to wit, participating in targeted protest at the home of the plaintiff Mark L. Bibi). This court found that the protestors failed to refute the evidence from the lower court that showed the plaintiffs were entitled to a permanent injunction as a matter of law (including evidence of the appellant's federal conviction conspiracy to violate the Animal Enterprise Protection Act of 1992). While the court did find that the appellant-protestor's incarceration did not render the appeal academic, imposition of the injunction was a reasonable and constitutional restriction on protest activity.

IA - Impoundment - 351.37. Dogs running at large--impoundment--disposition This Iowa statute provides that a dog shall be impounded by a local board of health or law enforcement official if the dog is running at large and the dog is not wearing a valid rabies vaccination tag. The statute requires that written notice be sent to the owner (if the owner's name can be reasonably determined from a tag or other source) who then has seven days to redeem the dog before it is euthanized.
IA - Ordinances - 331.381. Duties relating to services This Iowa statute states that the county board shall provide for the seizure, impoundment, and disposition of dogs in accordance with chapter 351.
IA - Ordinances - 351.36. Enforcement This Iowa statute provides that local health and law enforcement officials shall enforce state provisions relating to vaccination and impoundment of dogs. It further states that such public officials shall not be responsible for any accident or disease of a dog resulting from the enforcement of the provisions of the sections.
IA - Ordinances - Chapter 351. Dogs and Other Animals. This Iowa state provides that the chapter relating to state dogs running at large laws does not limit the power of any city or county to prohibit dogs and other animals from running at large, whether or not they have been vaccinated for rabies, and does not limit the power of any city or county to provide additional measures for the restriction of dogs and other animals for the control of rabies and for other purposes.
IA - Pet Shop - Chapter 162. Care of Animals in Commercial Establishments. The purpose of this chapter is to insure that all dogs and cats handled by boarding kennels, commercial kennels, commercial breeders, dealers, and public auctions are provided with humane care and treatment by regulating the transportation, sale, purchase, housing, care, handling, and treatment of such animals.
IA - Restaurant - Inspection standards for food establishments. This Iowa regulation was amended in 2020 by adding subsection 31.1(14) to allow "pet dogs" on exterior premises of a food establishment, including outdoor patio and outdoor dining areas, provided the food establishment meets all of the listed requirements. These requirements include: having a separate outdoor entrance; not allowing food preparation in the outdoor area or storage of reusable customer utensils; mandating that food or water dishes provided to dogs are single-use and disposable or come from the pet owners themselves; prohibiting contact between employees and the dogs; making sure the outdoor area is kept clean; ensuring that the area is immediately cleaned and sanitized if body fluids are excreted; making sure the outdoor area is not fully enclosed; requiring the removal of disruptive pet dogs; and posting of rules at the entrance. These rules include the leashing of dogs at all times, the prohibiting of dogs in the interior of the food establishment and on furniture, and the requirement to notify employees if the dog deposits any body fluid.
IA - Veterinary - Veterinary Practice Code These are the state's veterinary practice laws. Among the provisions include licensing requirements, laws concerning the state veterinary board, veterinary records laws, and the laws governing disciplinary actions for impaired or incompetent practitioners.
ID - Rabies - 500. DOGS AND CATS All dogs and cats imported into the state of Idaho must be accompanied by a CVI. Dogs and cats twelve (12) weeks of age or older shall be vaccinated for rabies.
