MI - Wolves - Control of gray wolves, § 324.95151 to 324.95167 This chapter of Michigan laws deals with the removal, capture, or destruction of gray wolves. According to the laws, a landowner is able to use any means necessary to remove a gray wolf from its property, including lethal force, if the gray wolf is threatening the landowners livestock or dog(s). Once a landowner has removed, captured, or destroyed a gray wolf, the landowner must report it to a department official no later than 12 hours after the removal, capture, or destruction. According to Section 324.95167, the act is not operative until final appellate court issues a decision overruling the decision of The Humane Society of the United States v Dirk Kempthorne that allows removal of wolves from the federal ESA list, or the U.S. Fish & Wildlife Service promulgates a final rule dated after March 12, 2007 that removes gray wolves located in this state from the list of endangered and threatened wildlife established under the federal endangered species act of 1973 and that final rule takes effect.
Miccosukee Tribe of Indians of Florida v. U.S.


This case examines the requirements surrounding the issuance of an Incidental Take Statement (ITS), a statement that authorizes harm to an endangered species, but that must include a trigger for reviewing the decision (known as “re-consultation”) at the point when there is a risk of jeopardizing the species. The trigger must be a numerical trigger describing the “take” (e.g., the capturing or killing of members of an endangered species) in terms of specific population data unless it is impractical to do so.

 

Specifically, this case explores whether the Army Corps of Engineers and FTS were able to use an ecological surrogate in place of a numerical trigger in an ITS that was promulgated in the process of conservation work in the Everglades.

 

This conservation work involved manipulating water levels in the Everglades and impacted the viability of three species protected under the Endangered Species Act (the Cape Sable seaside sparrow, the Everglade snail kite, and the wood stork), as well as the well-being of the Miccosukee Tribe of Indians.

Missouri Primate Foundation v. People for Ethical Treatment of Animals, Inc. This matter is a motion of counterclaim by defendants Missouri Primate Foundation to dismiss PETA's (the counterclaim plaintiff) assertion that two chimpanzees were being held in conditions that deprived the chimpanzees of adequate social groups, space, and psychological stimulation, putting them at risk of and causing physical and psychological injury, such as deteriorated cardiovascular and musculoskeletal health, stress, anxiety and depression. PETA also alleges that the chimpanzees were denied a sanitary environment, proper ventilation, a healthy diet, and adequate veterinary care. PETA claimed that the Missouri Primate Foundation (MPF) (the counterclaim defendants) were holding the two chimpanzees in conditions that “harm” and “harass” the chimpanzees, thus violating the “take” prohibition of the Endangered Species Act (ESA). MPF's motion contends that PETA’s counterclaim is based on allegations that they failed to comply with the Animal Welfare Act, not the ESA. MPF further contends that because the chimpanzees at its facility were lawfully in captivity and under the auspices of the AWA as administered by the USDA–APHIS, so the chimpanzees cannot be subject to a “take” under the ESA. They further argued that PETA lacked standing as the AWA preempts or supersedes the ESA as to animals held at USDA licensed facilities. Because the AWA does not allow citizen suits, MPF argued, the case must be dismissed. After examining similar cases, this court concluded that claims under the AWA and ESA are complementary and do not conflict, and that the ESA protects captive animals regardless of whether the alleged violator is an AWA licensed entity. The court found that the allegations by PETA are sufficient at this stage of the case and issues of proof are reserved for trial. As such, the court denied the motions of the counterclaim defendants.
MN - Endangered Species - Natural Resources (Ch. 83A-84). Chapter 84. Department of Natural Resources This statute protects endangered and threatened species in Minnesota, as defined in the statute. Under the law, a person may not take, import, transport, or sell any portion of an endangered species of wild animal or plant, or sell or possess with intent to sell an article made with any part of the skin, hide, or parts of an endangered species of wild animal or plant. Violation of the statute is a misdemeanor.
MN - Fish & Game - Chapter 97A. Game and Fish. Penalties These Minnesota statutes pertain to criminal sanctions for violations of fish and game laws. A person is guilty of a misdemeanor if s/he takes, buys, sells, transports or possesses a wild animal in violation of the laws. A person is guilty of a gross misdemeanor if s/he knowingly disregards no trespassing signs or trespasses after being notified not to trespass. It is also a gross misdemeanor to violate provisions relating to buying or selling fur-bearers, deer, bear, moose, elk, or caribou, fishing with illegal methods, and transporting animals over the limit. A gross misdemeanor may be punished by a fine and/or imprisonment.
MN - Habitat - Minnesota Environmental Rights Act (Chapter 116B. Environmental Rights) Minnesota protects the environment under the Minnesota Environmental Rights Act (MERA). Under MERA, citizens may bring suits for civil remedies where activities are interfering with their enjoyment of natural resources, including eagle nesting sites. The law provides a comprehensive scheme under which anyone with sufficient interest in protecting land, water, air, or any natural resources may bring suit to enjoin an action.
MN - Ivory - 84.0896. Trade in prohibited animal parts prohibited This Minnesota law, effective January 1, 2020, prohibits the sale of a "prohibited animal part." This is defined as a tooth or tusk from any species of elephant, hippopotamus, mammoth, mastodon, walrus, whale, or narwhal, or any piece thereof, whether raw or worked. Certain exceptions are written into the law including certain antiques (as defined), possession by a bona fide scientific or educational institution, and items expressly authorized under federal law.
MN - Wildlife, possession - Chapter 97A. Game and Fish. Possession and Transportation of Wild Animals. These Minnesota statutes restrict possession and transportation of wild animals. No one may transport wild animals taken, bought, or sold in violation of the game and fish laws. In general, a person may not take, import, transport, or sell an endangered species of wild animal, but there are exceptions.
MO - Endangered Species - Chapter 252. Department of Conservation--Fish and Game. This Missouri statute provides that the importation, transportation, or sale of any endangered species of fish or wildlife, or hides or other parts thereof, or the sale or possession with intent to sell any article made in whole or in part from the skin, hide or other parts of any endangered species of fish or wildlife is prohibited. Violation of the statute constitutes a Class B misdemeanor.

Plaintiffs filed claim against the United States Fish and Wildlife Service (“FWS”) alleging arbitrary and capricious agency action under the Administrative Procedure Act (“APA”) and failure to perform a nondiscretionary act under the Endangered Species Act (“ESA”).

 

The United States District Court, D. Oregon, granted Defendants’ motion to dismiss and denied Plaintiffs’ request for leave to amend, and Plaintiffs’ motion for summary judgment, finding

 

that it lacked subject matter jurisdiction over Plaintiffs’ APA and ESA claims, and that it remains without jurisdiction to mandate action by the agency if rulemaking has not been initiated by the FWS at its discretion, regardless of whether a determination resulting from a five year review suggests a listing status should be changed or should remain the same.
